1. These general terms and conditions apply to the training courses offered by Dr. Battke SCIENTIA GmbH. Courses are understood to be all further training events offered on a regular basis to an open group of participants on the premises of Dr. Battke SCIENTIA GmbH or elsewhere. Separate GTC, which we will send you with each respective offer, apply to further training events conceived and conducted in line with customers wishes with individually scheduled dates and/or content and other services of Dr. Battke SCIENTIA GmbH connected with further training events and consultancy. Special GTC also apply for the provision / rental of the premises of Dr. Battke SCIENTIA GmbH and related services.

2. The courses are conducted on the business premises of Dr. Battke SCIENTIA GmbH, Schlesierstrasse 4, in 82024 Taufkirchen. Other localities can be designated for the conducting of a course should it prove necessary to do so.

3. The prices listed for the courses include the materials, documentation, confirmation of participation and food during breaks (drinks, snacks and lunch) as listed in each course description, plus value-added tax at the rate currently valid in Germany. Basic equipment for personal protection during laboratory experiments, incl. lab coats, is provided.

4. To make a booking, please send us your contact data (incl. invoice address if different) per fax form, online form, e-mail or regular mail along with the course title and number, as well as the desired date of the course. Your booking is confirmed and becomes legally binding when you receive written confirmation from us. If a course is booked out on a specific date, we will suggest an alternative date for the same course.

5. Individual dates can also be arranged for the courses. Please let us know your preferred dates which we will be pleased to confirm, operations and training centre occupancy permitting. The courses can also be booked as on-the-job training on individually agreed dates. Please request our specifically prepared offers for each of these separate on-the-job training courses and dates. Special GTC apply to these services (cf. 1.).

6. Your training course booking becomes legally valid when you receive confirmation of registration from us. If you or any of the group participants are unable to attend a firmly booked course, other persons nominated by you can do so in your/their place. Bookings can only be cancelled in writing. Fees already paid for a training course cannot be refunded, however; they remain valid for the same course on a different date within one year. Cancellations can be made free of charge up to 2 weeks before the course is scheduled to begin; thereafter we charge a cancellation fee of 50% of the price of the training course (per person with group bookings). The remaining sum remains valid for one year as a down payment on a new booking. If you or any group participants do not turn up for a firmly booked training course without cancelling in advance, the sum already paid is forfeited and/or the price of the training course must still be paid in full.

7. If a course has to be cancelled by Dr. Battke SCIENTIA GmbH, the sum already paid will be refunded on request or your booking will be rescheduled for the same course at a later date with confirmation of booking. Further claims are excluded.

8. The instructions of the lecturer and representative of Dr. Battke SCIENTIA GmbH must be followed at all times, especially during experiments and practical work within the scope of the training course. No liability of any kind will be accepted for any damage or injuries resulting from non-compliance with instructions. Course participants are obliged in particular to check their personal suitability for the practical activities and notify the course management of any restrictions (pregnancy, allergies etc). In addition to this, all course participants are obliged to use their personal protective equipment and perform all tasks at their own risk in compliance with safety regulations and company directives. No liability of any kind will be accepted in the event of non-compliance with these regulations. In addition to this, course participants can be excluded from further participation in the course if there is good reason to do so, such as non-compliance with safety regulations or the instructions of the course management. The course fee will not be refunded in cases of this kind. In the event of grossly negligent or intentional damage to or destruction of equipment, operating materials or fittings and furnishings, we reserve the right to claim for damages. In addition to the direct damage, this will extend to indirect damage (consequential damage) such as loss of use etc.

9. Dr. Battke SCIENTIA GmbH does not accept any liability for damage to or theft of clothing and other items brought onto the premises. Liability for any damage attributable to Dr. Battke SCIENTIA GmbH is limited to intent and/or gross negligence.

10. Underage participants are obliged to present a statement of consent from a parent or guardian for participation in the training courses offered. Parents/guardians give their consent to the participation of minors in our courses under supervision and also permit them to perform practical tasks for training purposes at their own risk. They charge Dr. Battke SCIENTIA GmbH with the supervision of the underage participants for the duration of the training course. Underage participants will be under the supervision of an employee of Dr. Battke SCIENTIA GmbH specially instructed to do so for the duration of the course.

11. The courses begin when the participants enter the premises of Dr. Battke SCIENTIA GmbH to start the announced training course and end when they leave the premises at the end of the regular course programme. The intervals between training course sections or courses extending over several days are not part of the course itself. In particular, arrival at and departure from courses or course sections are at the risk of the participants, as is leaving the premises of Dr. Battke SCIENTIA GmbH during breaks. Break times (including individual breaks such as smoking breaks) spent outside the premises of Dr. Battke SCIENTIA GmbH are expressly not included in the scope of the training courses.

12. With the booking of and participation in a training course, the participant acknowledges these GTC without restriction.

13. Should any of the provisions of these GTC be invalid, this will not affect the validity of the other provisions.

14. The place of jurisdiction for all disputes is Munich.
